1. Acceptance and Scope
1.1 This Agreement is entered into between you and Xiang Wei, the developer and operator of Duo Wallpaper ("we", "us"), an individual developer, in respect of your downloading, installation and use of the App and related services.
1.2 This Agreement applies to the iOS client of the App and related supporting services (including the home screen widgets, push notifications, and membership services).
1.3 If you are under 14 years of age, please read this Agreement together with your legal guardian and use the App only with your guardian's consent.
2. Definitions
- App / Duo Wallpaper: the iOS wallpaper application developed by us and distributed on the Apple App Store (including the widget extension).
- User / You: any natural person who downloads, installs and uses the App on an Apple device.
- Wallpaper Content: images made available in the App for browsing and downloading, including static wallpapers and Live Photos.
- Member: a user who has obtained a membership via in-app purchase on the App Store, as further described in the Membership Purchase Agreement.
3. Account
3.1 Sign-In
3.1.1 The App supports guest mode; you may browse part of the wallpaper content without signing in.
3.1.2 Certain features require you to sign in using Sign in with Apple. Authentication is provided by Apple; we only receive the unique user identifier returned by Apple (and the email address you choose to share). We never see your Apple ID password.
3.2 Account Security
3.2.1 Your account is linked to your Apple ID. Please keep your Apple ID and device secure. We are not liable for losses caused by your voluntary disclosure of passwords, lending of devices, or attacks by third parties.
3.3 Account Deletion
3.3.1 You may request account deletion within the App (Profile → Delete Account). After deletion we will stop providing services to you and delete or anonymize your personal information in accordance with applicable laws and the Privacy Policy.
3.3.2 Account deletion is irreversible. Your membership and any unexpired membership benefits will terminate together with the account and cannot be transferred or refunded (except as otherwise provided by law).
4. Services
4.1 The App provides the following features and services:
- Wallpaper browsing: featured content, daily wallpapers, categories, rankings, collections, and search;
- Wallpaper download and saving: saving static wallpapers or Live Photos to your photo library;
- Widgets: displaying wallpapers on the home screen or lock screen via iOS widgets;
- AI wallpaper generation: creating personalized wallpapers from your uploaded reference image or prompt via AI models;
- Membership: unlocking additional content and benefits via in-app purchase on the App Store;
- Push notifications: wallpaper updates and content recommendations (subject to your authorization);
- Multilingual support, personalization settings, and other supporting features.
4.2 We will continuously improve the services and may adjust the content and form of the services from time to time.
4.3 The App requires an internet connection; content loading speed may vary with your network conditions.
5. User Conduct
5.1 When using the App, you agree not to:
- violate laws and regulations, endanger national security or public order, or offend public morals;
- infringe upon the reputation, portrait rights, intellectual property, trade secrets or other lawful rights of others;
- use technical means to scrape, copy or redistribute the wallpaper content in the App on a large scale;
- reverse engineer, decompile, maliciously attack, or implant trojans or viruses into the App;
- use the App for any illegal activities;
- otherwise violate any laws or this Agreement.
5.2 If you breach the above, we may take measures including warnings, feature restrictions, suspension or termination of services as appropriate, and reserve the right to pursue legal liability.
5.3 When you submit feedback or upload image or video attachments through the feedback feature, you warrant that you have the lawful right to the submitted content and that it contains nothing unlawful or infringing upon the rights of others. Your feedback and attachments will only be used to receive, analyze and reply to your feedback, as described in the Privacy Policy.
5.4 Rules for Using the AI Generation Feature
5.4.1 The "AI Wallpaper" feature of the App generates images based on AI models. Generated content is synthesized by artificial intelligence and is clearly labeled "Content is generated by AI" on the feature page; it is provided solely for your personal appreciation and use as a device wallpaper.
5.4.2 When using the AI generation feature, you undertake not to upload, enter, or request the generation of any of the following: content that violates laws or regulations or endangers national security or public interests; content that infringes upon the reputation rights, portrait rights, copyrights, trademark rights or other lawful rights of others; pornographic, violent, terrorist content or content that adversely affects minors; false information or other unlawful content.
5.4.3 For uploads or generation requests that violate the above rules, we and the service provider have the right to refuse generation, delete the relevant content, and take measures such as restricting features or banning accounts as appropriate; you shall bear the legal liability arising therefrom.
5.4.4 AI model outputs are random and may not match your expectations; we do not guarantee that generated results will meet your specific requirements. AI-generated images are virtual synthetic content and do not represent real persons or factual scenes.
6. Intellectual Property and Content License
6.1 Intellectual Property of the App
6.1.1 The overall design, source code, interface, and trademarks (including but not limited to "Duo Wallpaper") of the App are owned by us or the respective right holders and are protected by law.
6.2 License to Wallpaper Content
6.2.1 Wallpaper content displayed in the App comes from us and content providers. The wallpaper content is licensed to you solely for personal, non-commercial use: downloading, saving, and setting it as your device wallpaper.
6.2.2 Without the written permission of the right holder, you may not use the wallpaper content for commercial purposes, nor redistribute, resell, compile or create derivative works from it.
6.2.3 If you believe any content in the App infringes your lawful rights, please contact us via the channels at the end of this Agreement; we will handle it promptly after verification.
7. Membership
7.1 The App offers three membership plans via in-app purchase on the Apple App Store: lifetime membership, monthly subscription, and annual subscription. Benefits, pricing, auto-renewal terms, cancellation and refunds are set out in the Membership Purchase Agreement.
7.2 Please read the Membership Purchase Agreement carefully before purchasing. Auto-renewing plans can be cancelled at any time; after cancellation, renewal stops at the end of the current subscription period.
8. Third-Party Services
8.1 To provide analytics, push notifications, advertising, in-app purchase, and AI generation functions, the App integrates third-party services (such as Umeng+ analytics and push, Google AdMob advertising, Apple in-app purchase and sign-in, and Volcano Engine large-model services). How these services collect and use your personal information is described in the Third-Party Personal Information Sharing Disclosure.
8.2 Open-source components (e.g., networking, image loading, and animation libraries) run only locally on your device to implement App features and do not collect your personal information on their own.
9. Privacy and Personal Information
9.1 Protecting user personal information is one of our fundamental principles. We collect, use, store and share your personal information in accordance with this Agreement and the Privacy Policy.
9.2 We will not provide or sell your personal information to any third party, except as required by laws and regulations or with your separate authorization and consent.
10. Disclaimer and Limitation of Liability
10.1 The App is provided on an "as is" basis. We are not liable for service interruption or data loss caused by force majeure, telecom infrastructure failures, network congestion, changes to Apple systems or services, or device issues attributable to you, but we will do our best to minimize the impact on you.
10.2 You understand and agree that wallpaper content is solely for personalizing your device, and we are not liable for any consequences arising from your use of it.
10.3 To the maximum extent permitted by law, our total aggregate liability arising out of the App shall not exceed the amount you actually paid for the relevant membership service.
11. Changes, Suspension and Termination of Services
11.1 We may change, suspend or terminate part or all of the services based on business development. For material changes, we will notify you in advance through in-app announcements, push notifications, or other appropriate means.
11.2 You may stop using and uninstall the App at any time. Benefits of purchased memberships within their validity period are handled in accordance with the Membership Purchase Agreement.
12. Amendments to This Agreement
12.1 We may revise this Agreement in response to changes in laws and regulations or adjustments to the services. Revised versions will be published on this page or via in-app announcements.
12.2 If you continue to use the App after a revision takes effect, you are deemed to have accepted the revised Agreement; if you do not accept it, please stop using the App.
13. Governing Law and Dispute Resolution
13.1 The formation, performance, interpretation of, and dispute resolution under this Agreement shall be governed by the laws of the People's Republic of China (excluding Hong Kong, Macao and Taiwan).
13.2 In case of a dispute, we encourage you to first contact us via the channels at the end of this Agreement to seek an amicable solution; failing that, either party may bring a lawsuit before the people's court with jurisdiction at the defendant's domicile.
14. Miscellaneous
14.1 If any provision of this Agreement is held invalid, the remaining provisions shall remain in full force.
14.2 This Agreement, together with the Privacy Policy and the Membership Purchase Agreement, constitutes the entire agreement between you and us. In respect of membership matters, in case of any inconsistency between this Agreement and the Membership Purchase Agreement, the latter shall prevail.
